......The only defense if caught recording(it's not against the law until your caught)... is find another legitimate reason (for your safety, comes to mind)
Perhaps a legitimate reason is to prove that the person you are having sex with is having sex with full consent, i.e., to be used as a defense that the sex was not unwanted or coerced.

Three reasons come to mind: If you had a particularly good experience, seeing it again helps you relive it; sometimes when your face is buried between her legs you can't see her facial expressions as she gets off; when she is on all fours and you are concentrating on gently positioning and putting pressure with your dick on her anus, you can't see her facial expressions the instant her sphincter relaxes and you slide in.

So while I'm not suggesting secret filming for reasons stated a few times above, and maybe a few others, this particular code doesn't seem to apply if it's kept for personal use only.
In practice it applies to anything on the internet. So even if you upload it to your private cloud it applies. And just to save you time trying to find loopholes I'm telling you how it actually works.

I have no need to find loop holes. I did say I wouldn't suggest it. I merely stated from the way it was written it didn't sound like it applied but I'm sure there are plenty of other statutes that do. I can see how uploading to the cloud would apply if the storage was across state lines. And I agreed with "on the internet" which is also why I specified for personal use. I guess I could have been more specific to the recording staying on the recording device or your personal computer which is what I was thinking when I wrote it. Either way, I have no intention of testing the hypothesis.

I’m sure all the single guy Hollywood stars and Sports stars record, due to the gold diggers of our time. Even if it’s illegal. Better off being charged with this crime then one that would put you away for 20-30 years.

If you are determined to do this be smart, don't keep videos where they can be found. Not on your PC, not uploaded to the cloud. On a flash drive that is hidden somewhere and very difficult to find. Or on individual SD cards. Record one session on each. They are cheap enough. I always shake my head in amazement when I read about someone busted with a bunch of videos of their crimes on their PC or cloud.

Interesting read, does recording audio apply as well? I have been told that recording a conversation in NY is ok if one party consents/is aware? but how does that apply to a sexual activity?

To confirm your first point, according to the Digital Media Law Project's website:
"New York's wiretapping law is a "one-party consent" law. New York makes it a crime to record to record or eavesdrop on an in-person or telephone conversation unless one party to the conversation consents. N.Y. Penal Law §§ 250.00, 250.05. [...] Thus, if you operate in New York, you may record a conversation or phone call if you are a party to the conversation or you get permission from one party to the conversation in advance."

As to your question regarding the application to sexual activity, according to another legal website:
"In a case of first impression that required a NY Appellate Court to look at decisions from Michigan and Indiana for guidance, the Third Department held that videotaping a consensual act without a partner’s knowledge violates New York’s laws against unlawful surveillance."

To sum up, if you are recording a conversation that you are engaged in, then, by all means, feel free to record it, but if the other party is using their mouth (or any other orafice) for something more intimate, then I would caution against any attempt to record said encounter.

It would be nice if anyone in the media would add that the reason for the secret recording was for "trafficking" while no evidence was found for that. I don't know law but I thought those kinds of warrants limit it to the purpose of what's in the warrant? If that true, the case should be dismissed?
All the media was concerned about getting the rights to the video as well.

There are tons of hidden recording device you can use and no one will know. I got a few of them and when I’m in a session I turn it on and it’s in plan site and no one know it’s recording the session. Items such as

1. Auto alarm key
2. Cellphone case
3. Battery pack

Just mentioning a few of them. But there’s a lot more available. Also if you have lady friend come over to your place you can get alarm clocks, clock on wall, smoke detectors, so on. If you travel or just rad use a hotel room you can get a traveling alarm clock. The camera in all of these camera are different and give out different quality. Do you guy remember sometime ago a monger recorded a session and posted on one of these porn sites. When it was mention here he ended up deleting it off the site and asking the mod to delete the thread on here. I still have that video cause I downloaded it. That’s why if anyone record a session keep it for your own viewing.

Some (Maxine in the city) will let you record for free just no shots of her face. The real expensive ones (over 350) often include it (gina rollins not only allows it she hams it up).

Then it's consensual, you still get your whackoff vid and no breaking more than one law at once.

Technically only New Hampshire and California have a court precedent to create/ publish porn, all other states is a technical grey area. However as protection in the advent your caught up in a "escort" raid and claim porn movie creation...

You'll need an "acting" consent form and age verification; compliance with Section 2257.

    • performer’s legal name, stage name, and/or aliases.
    • Record the date of original production of the depiction
    • Identify the title of the work associated with the depiction.
    • Capture the front and back of the performer’s picture ID card using a camera.
    • Sign and verify the accuracy of the information
    • Send the 2257 records file to the records custodian - i.e. yourself.
  • avoiding obscenity concerns - of the community you'll be filming in. So in NY pretty much anything goes.

Probably nothing new to anyone here, but just an FYI for people that don't already know. Sex regret is also a thing, and has been more prevalent lately.

Any alcohol? I did a quick check and didn't see that was the case. From what I read it was when the female passed out and was unable to consent, implied or otherwise.
Not saying you're wrong but do you have any links on that?
